General Terms and Conditions

1. Scope

These General Terms and Conditions apply to the rental and duration of stays in holiday accommodation arranged by Espiral Azul, Lda. , Rua Dr. Luiz António dos Santos, 16, 8400-220 Ferragudo-Lagoa, Algarve, Portugal.

Espiral Azul, Lda. is hereinafter referred to as E.A. The holiday properties are exclusively represented and arranged by E.A.

2. Services and use of the accommodation

The scope of the contractual services is determined by the description of the respective holiday property, the written booking confirmation and any additional services agreed by telephone or email.

For arrivals between 07:00 and 23:00, guests will be met at the property by prior arrangement. Keys will be handed over and guests will be provided with the necessary information about the accommodation.

For arrivals outside these hours, an additional charge of EUR 20.00 may apply.

The holiday accommodation may only be occupied by the number of adults and children stated in the booking confirmation. Additional occupancy that has not been agreed in advance may result in termination of the stay.

• Pets are only permitted by express prior agreement.
• Smoking is not permitted inside the accommodation.
• The agreed arrival and departure dates are binding.
• On the day of departure, the accommodation must normally be vacated by 10:00.

3. Prices

The prices stated are final prices per accommodation unit, unless otherwise specified in the respective offer or booking confirmation.

Prices generally include the applicable VAT as well as the cost of electricity, water, gas, bed linen and towels.

Different conditions may apply to long-term stays and Winter Living offers. These will be expressly stated in the respective offer.

A separate cleaning charge will only apply where this is expressly stated in the offer or booking confirmation.

4. Booking and payments

Upon conclusion of the contract and receipt of the written booking confirmation, a deposit of approximately 30% of the accommodation price becomes due.

The remaining balance must be paid no later than four weeks before the start of the stay. For bookings made within six weeks of the start of the stay, the full accommodation price becomes due.

Payments should be made to the following account:

E.A. issues an official invoice for each contract, together with the appropriate receipts for payments received.

5. Cancellation by the customer

The customer may cancel the contract before the start of the stay. The effective date of cancellation is the date on which the cancellation notice is received by E.A.

Cancellation should be communicated in writing, for example by email.

In the event of cancellation, E.A. may claim reasonable compensation for costs already incurred and loss of revenue.

We recommend taking out travel cancellation insurance.

In the event of cancellation, the following amounts will be due:

6. Damage to the accommodation

The customer must notify E.A. immediately of any damage occurring to the accommodation during the stay.

In accordance with the applicable legal provisions, the customer is liable for damage to the accommodation, its furnishings or communal areas caused by the customer or by persons travelling with them.

Any clarification and, where necessary, settlement of the damage should, wherever possible, take place during the stay.

7. Complaints and remedies

If the agreed services are not properly provided, the customer may request that the situation be remedied.

The situation may also be remedied by providing an equivalent alternative service.

Any problems or complaints concerning the accommodation must be reported immediately during the stay so that an appropriate solution can be provided.

Following the end of the stay, any claims or rights may only be exercised in accordance with the applicable law.
